Actually, the liberals have an easier plan to get rid of the 2nd Amendment. All they need is one more Supreme Court justice, and if Hillary Clinton had been elected, that need would, in all likelihood, have been filled. But that doesn’t deal with state constitutional protections, it doesn’t get confiscation legislation passed at the federal level, and it doesn’t begin to address the impossible task–as Cooke ably describes it–of actually carrying out the confiscation.

Do liberals have the stomach for any of this? It doesn’t seem so. They could have passed whatever “common sense” gun legislation they wanted during the time when they controlled the House, had a filibuster-proof majority in the Senate, and Barack Obama as president. But they didn’t touch gun issues with a stick. Which pretty much proves that their only interest in the subject is political.

And now: The healthcare plan that we should have had in the first place!

Republicans will say to Democrats, "Help us create the new insurance system or be responsible for the consequences." Some are saying the Democrats won't cooperate. Here is why they will. In 2018, there are 23 Democratic and two Independent Senators (who caucus with the Dems) that will be up for reelection––a great many in states that Donald Trump won last night! There is a clear mandate here to replace Obamacare. If these Democrats fight it and that arguably results in millions of people thrown off their coverage they will do so at their peril.

The best news here is that defunding and then replacement of Obamacare could ironically set the table for the first real bipartisan legislative effort in a very long time. The one we should have had in the first place.

How to get rid of Obamacare

Certain provisions of the president's reform plan kicked in immediately. But many of Obamacare's main provisions and cost drivers do not take effect until 2014. As of mid-July 2011, there are more than 9,000 pages of rules and Federal Register notices related to Obamacare.

Consequently, there is still time to reverse course. Our congressional leaders can repeal Obamacare and replace it with market-based reforms that actually expand access to coverage, provide quality care, and reduce the cost of health care.

OBAMACARE: Many of its changes don't kick in until 2014. But the law is forcing dramatic consolidation and reducing choice in the industry...

The Republicans who now control the House of Representatives hope to repeal or defund ObamaCare, but the law has already yielded profound, destructive changes that will not be undone by repeal or defunding alone. Active steps and new laws will be needed to repair the damage.

The most significant change is a wave of frantic consolidation in the health industry. Because the law mandates that insurers accept all patients regardless of pre-existing conditions, insurers will not make money with their current premium and provider-payment structures. As a result, they have already started to raise premiums and cut payments to doctors and hospitals. Smaller and weaker insurers are being forced to sell themselves to larger entities.

Doctors and hospitals, meanwhile, have decided that they cannot survive unless they achieve massive size—and fast. Six years ago, doctors owned more than two-thirds of U.S. medical practices, according to the Medical Group Management Association. By next year, nearly two-thirds will be salaried employees of larger institutions.

Consolidation is not necessarily bad, as larger medical practices and hospital systems can create some efficiencies. But in the context of ObamaCare's spiderweb of rules and regulations, consolidation is more akin to collectivization. It means that government bureaucrats will be able to impose controls with much greater ease.

With far fewer and much larger entities to browbeat, all changes in Medicare and Medicaid policies will go through the entire system like a shock wave. There will be far fewer individual insurers, doctors, hospitals, device makers, drug manufacturers, nursing homes and other health-care players to resist.

There is little mystery how the government will exercise its power. Choices will be limited. Pathways to expensive specialist care such as advanced radiology and surgery will decline. Cutting-edge devices and medicines will come into the system much more slowly and be used much less frequently.

This is why simply defunding enforcement of the individual mandate and other upcoming directives will not be enough: Given all this consolidation, limits on treatment choices are already becoming hardwired into the system. Lawmakers must take concrete steps to stop and reverse this. . .

Republicans need to remind America that the huge increases they are now paying in their health insurance are concrete evidence of the impact of the mandates in Obamacare. They need to point out that the $500 billion in Medicare cuts are coming and that, already, reductions in physician fees are driving thousands of doctors to close their doors to Medicare patients. The Republicans need to explain how Obamacare creates an entirely new entitlement and will swell the deficit.

A measure in the U.S. House of Representatives that would force the chamber into a new vote on Obamacare, even if House Speaker Nancy Pelosi doesn't want it, is halfway toward its needed support.

Advocates say constituents need to call their representatives to tell them to get on board right away so that the petition is positioned to move forward whether or not the GOP becomes the majority in the House after the 2010 fall elections.

The plan is a discharge petition pushed by Rep. Steve King, R-Iowa.

If Ms. Kagan disdains Lopez, she is all but certain to rule against the states on ObamaCare. On this point, someone should ask Ms. Kagan whether Congress has the power to force individuals to buy certain cars—say, Chrysler's, now that the U.S. taxpayer has bailed out that auto maker?

Obama's Health Care Promises Already Busted

The ink was barely dry on President Obama's signature before the RAND Corporation released a report concluding that not only would the hard-won health care package fail to curb premium increases, but the bill would drive premiums up as much as 17 percent for young people.

And then there's this:

...the Congressional Budget Office now says that as many as 10 million workers will lose their current insurance under the bill. Some of those will have to buy new insurance through the government-run exchanges. Millions more will be thrown onto Medicaid.

In addition, the Center for Medicare and Medicaid Studies reports that half of seniors enrolled in the Medicare Advantage program will lose their coverage under that program and be forced back into traditional Medicare.

And this:

...the government's chief actuary released his report on the bill recently, showing that the bill will actually increase health care spending by $311 billion over the next 10 years.

At the same time, the actuary warns that promised future spending cuts, particularly those for Medicare, are unlikely to occur.

And, finally:

Now the most recent report from the Congressional Budget Office warns that nearly 4 million Americans, nearly three-quarters of them middle-class workers, will be hit with fines for failing to meet the government's mandate. Those penalties will average nearly $1,000 per person in 2016.

All this, and the health care "reform" law is merely a month old.

Perhaps this is why nearly 56 percent of American voters now favor repealing the bill.
