The American public often is reminded, usually by Barack Obama, Joe Biden, and their loyalists in the American news media, that Obama’s eight-year reign was “scandal-free.” Of course, that is nowhere near the truth. From the “Fast and Furious” gun-running scam and IRS targeting of Tea Party activists to the egregious Benghazi terror attack cover-up two months before the 2012 election, the Obama Administration was among the most corrupt in U.S. history. And they have laughed all the way to Martha’s Vineyard and the Democratic presidential debate stage.

So truth-seekers should be gratified that on one day—Monday, December 9, 2019—the spin and subterfuge that the Obama White House successfully employed to hide their rampant malfeasance started to collapse under the full weight of its deceit and hubris.

The CIA must have a "Presidential Finding" issued by the President of the United States in order to conduct these activities under the Hughes-Ryan amendment to the 1991 Intelligence Authorization Act.^[1] These findings are then monitored by the oversight committees in both the US Senate and the House of Representatives.^[4] As a result of this framework, the CIA “receives more oversight from the Congress than any other agency in the federal government”.^[5] The Special Activities Division (SAD) is a division of the CIA's National Clandestine Service, responsible for Covert Action and "Special Activities". These special activities include covert political influence and paramilitary operations.

According to the Department of Defense Dictionary of Military and Associated Terms, a covert operation (also as CoveOps or covert ops) is "an operation that is so planned and executed as to conceal the identity of or permit plausible denial by the sponsor." It is intended to create a political effect which can have implications in the military, intelligence or law enforcement arenas. Covert operations aim to fulfill their mission objectives without any parties knowing who sponsored or carried out the operation.

...The history of executive–congressional relations is filled with accommodations and waivers of privilege. In contrast to voluntary waivers of privilege, Watergate demonstrates that wrongful invocations of privilege can seriously damage the office of the presidency when Congress and the courts impose new constraints on the President’s discretion or power (some rightful and some not).

But there is at least one helpful development in Holder’s request that the President invoke executive privilege to shield these documents: The President now owns the consequences of further stonewalling. There is no ongoing DOJ prosecution or investigation to protect. There is no obvious reason why the President can’t waive even what legitimately privileged documents there are (which is probably far fewer than the 1,300 pages being withheld).

The American people will now clearly understand that it is President Obama who doesn’t want them to know who is to blame for the Fast and Furious scandal—and whether his Administration has done anything to prevent it from happening again.

Why Obama's claim of Executive Privilege is frivolous

Today Deputy Attorney General James Cole advised Darrell Issa, Chairman of the House Oversight and Government Reform Committee, that the Department of Justice will not respond to the committee’s subpoena of certain documents relating to the Fast and Furious scandal. Instead, the Obama administration is asserting a claim of executive privilege for the reasons laid out in Eric Holder’s letter to President Obama dated June 19.

Holder’s letter is a remarkable document. Viewed from a strictly technical standpoint, it is a terrible piece of legal work. Its arguments are weak at best; in some cases, they are so frivolous as to invite the imposition of sanctions if they were asserted in court.

L.A. Times: Congress expands Fast and Furious probe to White House

Congressional investigators reviewing the failed gun-tracking program Operation Fast and Furious have formally asked the Obama administration to turn over copies of "all records" involving three key White House national security officials and the program, other ATF gun cases in Phoenix, and all communications between the White House and the ATF field office in Arizona.

The letter signed Friday by Rep. Darrell Issa (R-Vista), chairman of the House Committee on Oversight and Government Reform, and Sen. Charles E. Grassley of Iowa, the top Republican on the Senate Judiciary Committee, was sent to National Security Advisor Thomas E. Donilon, a top aide to President Obama.

It marks a significant step in the committee's investigation into the failed gun-tracking operation, as the committee begins to broaden its investigation from the federal Bureau of Alcohol, Tobacco, Firearms and Explosives and targets White House and Department of Justice officials.

This material, Issa and Grassley said, "will enable us to determine the extent of the involvement of White House staff in Operation Fast and Furious."

So now the current issue is whether Eric Holder should be held in contempt. The EPA scandal of the Reagan years, and other issues such as the Travel Office and U.S. attorney firings, pale in comparison to the deadly Fast and Furious scandal, along with its apparent cover-up.

Since the gun-walking scandal has been linked not only to the murder of Border Patrol Agent Brian Terry in 2010, but also to the death of U.S. Immigration Agent Jaime Zapata in 2011, as well as to the deaths of 300 Mexicans, there is absolutely no reason for Eric Holder not to comply with the subpoena.

The public, as well as the victims of the deadly government operation, deserves to know the truth. Last June, in hearings before the House Oversight Committee, members of Brian Terry's family spoke, and Terry's cousin, Robert Heyer, said that other members of the Border Patrol nicknamed the former Marine "Superman."

During training for the elite tactical BORTAC unit, Terry was assigned to write something about himself. It was a poem entitled, "If This Is To Be The Day, So Be It." Terry wrote of being trained and ready to give everything he had to give, and willing to die, if necessary.

"I do not fear death," he wrote, "for I have been close enough to it on enough occasions that it no longer concerns me. But I do fear the loss of my honor, and would rather die fighting than to have it said that I was without courage."

Heyer concluded that Terry had lived a life of honor, duty, and sacrifice. "It is now up to all of us to put honor first and to remain faithful in the quest for justice."
