The Obama administration has sent the Iran nuclear deal to Congress for a 60-day review provided by the Corker bill. However, President Barack Obama has pre-empted Congress by going to the UN Security Council first, which has already voted to end international sanctions and accept the deal. Furthermore, even if Congress rejects the deal, it will struggle to muster a two-thirds majority to override the president’s veto.

There is one effective way, however, that the Iran deal can be rejected: states and local governments can refuse to comply with it.

That may come as a surprise. States and local governments do not play much of a role in foreign policy. However, they cannot be forced to implement an international treaty or agreement that is not self-executing–i.e. one whose implementation requires new congressional laws.

The Senate is now considering a bill that Sen. John Kerry, D-Mass., co-authored to create a European-style "cap and trade" system for carbon dioxide emissions, and he just won the endorsement of a key swing senator. International pressure on the United States to adopt such legislation also will increase in December at climate talks in Copenhagen.

That's bad news for taxpayers. The Obama administration reluctantly admitted last month that cap-and-trade would cost the average American family $1,761 a year.

That is a rosy prediction. A Heritage Foundation analysis pegs the cost at an average of $2,979 a year and as much as $4,600 a year by 2035. Jobs will disappear, energy prices will skyrocket, and the American Dream will become an unattainable fantasy for many.

John Kerry can't stop digging his own grave

John Kerry: Unfit, period.
Jean-Francois Kerry and the Swift Boat Veterans for Truth are at it again.

In October 2003, Kerry chose to make his disputed Vietnam war record as a Swift Boat “hero” the centerpiece of his campaign for the presidency. In doing so, he also called attention to his undisputed provision of “aid and comfort” to the enemy in time of war.

In response, a large contingent of Vietnam vets who also served on Swift Boats—some who served with Kerry, some who served in the same area as Kerry, and some who were Kerry’s former commanding officers (Grant Hibbard and George Elliott)—challenged Kerry’s record in a series of televised ads, and a book, Unfit for Command.

In all, more than 250 Swiftees, including Kerry’s entire chain of command, are on record as questioning his fitness to serve as Commander in Chief. Conversely, only three of Kerry’s 23 fellow officers-in-charge from Coastal Division 11 support him.

The Swiftees claimed that Kerry was “unfit to serve” because of his “willful distortion of the conduct” of American servicemen in Vietnam, and the “withholding and/or distortion of material facts” regarding his own service.

“The ads were produced to expose the braggart Kerry’s incautious claims about his service during the Vietnam War,” notes American Spectator editor R. Emmett Tyrrell. “That would be the war Kerry participated in briefly before coming home and traducing his fellow comrades in arms with vicious lies and distortions before the Senate Foreign Affairs Committee.”

The Swiftees’ challenge also highlighted Kerry’s participation with the radical “New Soldier” movement, but Kerry arrogantly brushed off the challenge—and his presidential aspirations were dashed.

Two weeks ago, billionaire entrepreneur T. Boone Pickens, who had funded part of the 2004 SBVT ad campaign, renewed the challenge by offering $1,000,000 to anyone who could disprove any of the accusations made by the Swiftees in that ad campaign.

That was the setup.

In a letter to Mr. Pickens, Kerry responded, “While I am prepared to show the so-called Swift Boat Veterans for Truth lied on allegation after allegation, you have generously offered to pay one million dollars for just one thing that can be proven false. I am prepared to prove the lie beyond any reasonable doubt.”

Pickens countered Kerry: “In order to disprove the accuracy of the Swift Boat ads, I will ultimately need you to provide the following: 1) The journal you maintained during your service in Vietnam. 2) Your military record, specifically your service records for the years 1971-1978, and copies of all movies and tapes made during your service. When you have done so, if you can then prove anything in the ads was materially untrue, I will gladly award $1 million.”

That is the trap.

Of course, Kerry’s response has gotten plenty of media play in more than 300 articles sporting headlines like “Kerry Takes Vows to Disprove Swift Boat Claims,” and even Leftmedia editorials proclaiming, “Bravo, finally, for John Kerry. Beyond any doubt he served this country bravely...”

But no evidence refuting the Swiftees’ claims has been forthcoming, nor will it be. Kerry is banking on MSM credit for accepting the Pickens challenge without ever showing up.

Kerry is now ducking the challenge, claiming that Pickens’s request for bona fide documentation constitutes “selectively backing away from your original challenge, retreat, a new bet, and changing the subject.” In other words, if Pickens won’t just accept Kerry’s word as fact, Kerry will not accept the challenge.

The debate about Kerry’s “hero” status, including questions such as why his Silver Star has three different citations (none of which account for the degree of valor commensurate with the award), will likely never be adequately resolved. In fact, Kerry’s refusal to release his DoD Standard Form 180 and DD214, accounting for all his military citations, records and discharge from the military, has fueled the debate.

Kerry requested an SF-180 back in 2005, and the Department of Defense quickly obliged, so why all the obfuscation—why not simply release the entirety of his records? Perhaps, because those records would create more questions than they answer?

Kerry did provide some of his records to his hagiographer, Douglas Brinkley, and then claimed he could not release those records to the media because of an exclusive agreement with Brinkley. However, even Brinkley says that their agreement stipulates only that quotations from those records cite his book, not that Kerry was prohibited from releasing them otherwise.

The dispute about Kerry’s Vietnam conduct and citations notwithstanding, the real issue is not Kerry’s service record, but his traitorous actions between 1971 to 1978, when he was discharged from the Navy—which is why Pickens asked for Kerry’s service records for those years.

Was Kerry’s discharge revised in accordance with Jimmy Carter’s Executive Order 4483, which provided radical protestors and draft dodgers blanket pardons? Is that why his discharge was subject to review by a “board of officers” in accordance with Title 10, U.S. Code Section 1162 and 1163, which pertains to grounds for involuntary separation from military service?

Here is a sure bet: Kerry will not produce those records because he knows Pickens will use them to document our case against Kerry for treason, as outlined in the Petition to Investigate and Indict John F. Kerry for acts of treason.

Kerry provided “aid and comfort” to the North Vietnamese enemy during the Vietnam War, meeting in Paris with NVA communists while he was a commissioned Navy officer.

He has supported Communist dictators in Nicaragua and Cuba, and, more recently, his flip-flopping on Iraq and claim that those serving there are “stuck in Iraq” because they are too ignorant to do anything else have served to stiffen our enemies’ resolve.

At best, Kerry, by his own account of his actions and protests, violated the Uniform Code of Military Justice, the Geneva Conventions and the U.S. Code while serving as a Navy officer.

Most notable among his infractions would be the aforementioned meeting with North Vietnamese negotiators in 1970 and 1971, in which he willingly placed himself in violation of Article Three, Section Three of the U.S. Constitution, which defines treason as “giving aid and comfort” to the enemy in time of warfare.

The pertinent language states: “No person shall be a Senator or Representative in Congress, or elector of President and Vice-President... having previously taken an oath... to support the Constitution of the United States, [who has] engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”

It is likely that no action will be taken on the Petition to Investigate and Indict John F. Kerry for acts of treason while Kerry is a sitting senator, but if Pickens is able to obtain Kerry’s records and document his meetings with North Vietnamese principals, Kerry could be prosecuted for violations of Article Three, Section Three, and disqualified from any future campaign for national office.

Like Pickens, The Patriot is committed to holding Mr. Kerry accountable for his actions, as there is no statute of limitations for acts of treason. Indeed, we are all committed to serving Kerry with an irrevocable dishonorable discharge from public office.

Now, then, Mr. Kerry, about that million-dollar challenge from Mr. Pickens: We’re still waiting...

We suppose this meeting hinges on the meaning of the word “mutually.”

Clinton appoints thief as advisor to her campaign

WASHINGTON (Map, News) - Sandy Berger, who stole highly classified terrorism documents from the National Archives, destroyed them and lied to investigators, is now an adviser to presidential candidate Hillary Rodham Clinton. Berger, who was fired from John Kerry’s presidential campaign when the scandal broke in 2004, has assumed a similar role in Clinton’s campaign, even though his security clearance has been suspended until September 2008. This is raising eyebrows even among Clinton’s admirers. “It shows poor judgment and a lack of regard for Berger’s serious misdeeds,” said law professor Jonathan Adler of Case Western Reserve University, who nonetheless called Clinton “by far the most impressive candidate in the Democratic field.”

Adler told The Examiner that it is “simply incomprehensible to me that a serious contender for the presidency would rely upon him as a key foreign policy advisor.”

He added: “If Senator Clinton becomes the Democratic nominee, at some point she will begin to receive national security briefings that will include sensitive information. At such a point, continuing to keep Berger on board as a key advisor, where he might have access to sensitive material, would be beyond incomprehensible.”

The Clinton campaign declined to comment.

Gore repeatedly asks that science and reason displace cynical political posturing as the central focus of public discourse.

Turns out, he should be giving that speech in front of a mirror!!!

Looks like he's been trying to "use" science for his own political gain (boy, he and John Kerry both had a huge pscychological hard on to be President--and that's exactly the type of person you do NOT want in that office because they feel they were born to it like the Kings of yore).

POWs LAWSUIT COULD FORCE KERRY TO COME CLEAN ON VIETNAM ‘WAR CRIMES’ CHARGES

When John Kerry slandered an entire generation of men who fought in Vietnam he branded them as "war criminals." Today, much of the same thing is being said about our young men and women in Iraq.

Now, a lawsuit filed in Philadelphia’s Court of Common Pleas will test the very foundation of Kerry’s anti-war persona for the first time. It isn’t dubious medals or Kerry’s disputed service record in Vietnam that is being called into question. This time Kerry may finally be forced to answer for the events that launched his public career, one that made him an anti-war hero for many American liberals and a turncoat for millions of Vietnam veterans.

The lawsuit (Vietnam Veterans Legacy Foundation, et al. v. Kenneth Campbell, et al.) challenges the basis, the factual accuracy of then Lt. (j.g.) Kerry’s acrimonious testimony before the U.S. Senate Foreign Relations Committee in 1971. It was there Kerry’s public career was catapulted with his now ubiquitous portrayal of American soldiers as murderers, rapists and torturers "who ravaged the countryside of South Vietnam . . . [and] razed villages in a fashion reminiscent of Genghis Khan."

For the anti-war, anti-American protesters, the American soldiers are the "terrorists," and the enemies are the victims of a barbaric U.S. military which tortures and murders defenseless civilians.

That false premise, one of the most vicious and enduring smears spawned by Kerry 35 years ago, will also be put to the test once Kerry’s true "Band of Brothers" are put under oath in a Philadelphia courtroom.

The background to this lawsuit is long and complex, but even a condensed version is rich in irony and poetic justice.

It had it roots in 2004 with the documentary Stolen Honor: Wounds that Never Heal. Many may recall the film, although it is probably best known for not being seen, suppressed after Sinclair Broadcasting Company courageously announced it was going to air the documentary in its entirety. Thanks to Kerry and his liberal colleagues in the Senate and their enablers in the mainstream media, Sinclair was browbeaten into withdrawing the film, its broadcast license threatened by a Kerry campaign manager in 2004. The film’s producer, Carlton Sherwood, a Pulitzer Prize and Peabody Award-winning investigative reporter, interviewed former POWs for the documentary.

I was among those whom Sherwood, a decorated Marine combat veteran himself, asked to participate in Stolen Honor. I was a POW for nearly six years, held in North Vietnam prison camps, including the notorious Hanoi Hilton, a place of unimaginable horrors -- torture, beatings, starvation and mind-numbing isolation. When Kerry branded us "war criminals," he handed our captors all the justification they needed to carry out their threats to execute us. Thanks to Kerry, Jane Fonda and their comrades in the anti-war movement, our captivity was prolonged by years. The communists in Hanoi and Moscow couldn’t have had a better press agent to spread their anti-American propaganda.

To guarantee Stolen Honor would never be seen by anyone – not even theatre-goers – the producer was slapped with a libel and defamation lawsuit.

The POWs and the wives of POWs who participated in Stolen Honor refused to abandon the facts conveyed in the film. For some of us, it was the first time since our release by the Communists in 1973 that we were able to have our voices publicly heard, to tell our stories about the consequences of Kerry’s treachery. In 2005, we formed a nonprofit organization, the Vietnam Veterans Legacy Foundation (VVLF), to gather records, documents and other materials to form a fact-based, educational repository for students and scholars of Vietnam history and to tell the true story of the American soldiers in Vietnam. The VVLF’s mission is "to set the record straight, factually, about Vietnam and those who fought there."

For our efforts, we were promptly sued by Campbell and another long-time anti-war Kerry follower and VVAW member, Dr. Jon Bjornson. It was clear that Kerry not only wanted to punish us for Stolen Honor; he intended to use surrogates to sue us into permanent silence and financial ruin.

Col. George E. "Bud" Day, USAF (Ret.,) was a POW in North Vietnam for five years, seven months and 13 days. He served in three wars (WWII, Korea, and Vietnam) and earned the Medal of Honor. He is the Air Force’s most decorated living veteran. Democrats violate the Logan Act?

Drudge reports that Hamas in talks with Democratic Party in a secret location...

Hamas officials have managed to smuggle more than $66 million in cash through the Rafah border crossing in the past eight months, a member of the Hamas-led government revealed Wednesday.

Meanwhile, sources close to the Hamas-led government claimed that Hamas representatives recently held talks with officials from the US Democratic Party at a secret location.

Now, this immediately brings to mind the Logan Act:

Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.

This section shall not abridge the right of a citizen to apply himself, or his agent, to any foreign government, or the agents thereof, for redress of any injury which he may have sustained from such government or any of its agents or subjects.

Why, you might ask?

Many of us have long ago given up hope that obstreperous liberals in Congress who deliberately weaken our country's position in a time of war will face appropriate repercussions.

Just in case you think the Democrats are oh-so-much-more-brilliant at foreign policy, you'd better re-adjust your reading glasses:

A longtime aide to Jimmy Carter has resigned from the Carter Center think tank, calling the former president's new book on Israel and the Arabs one-sided and filled with errors.

Kenneth Stein, the Carter Center's first executive director and founder of its Middle East program, sent a letter that bluntly criticized the book to Carter and others.

Stein wrote that the book, "Palestine: Peace, Not Apartheid," was replete with factual errors, material copied from other sources and "simply invented segments," according to an excerpt of the letter published by the Atlanta Journal-Constitution.

Parents of Iraq war troops visit Iraq as a response to John Kerry's insult

Parents of U.S. troops who died in Iraq have quietly slipped in to the Middle East nation to offer support to its people and to American servicemen and women.

Coming on the heels of Sen. John Kerry's widely publicized comment suggesting military service is a refuge of the lazy and uneducated, the parents say they also want to rebut the Massachusetts Democrat.

"I am spitting mad at John Kerry for insulting our troops. Duck and run was his specialty in Vietnam," said Gold Star mother Debra Argel.

Organizer Move America Forward said, to its knowledge, no other such trip to Iraq by families of fallen troops had ever taken place.

In a letter dated 14 May 1983, KGB head Viktor Chebrikov wrote General Secretary of the Communist Party Yuri Andropov regarding our very own Sen. Ted Kennedy’s offer to assist Soviet leaders with a counter public-relations strategy to President Ronald Reagan’s successful foreign policy. Former U.S. Sen. John Tunney repeatedly traveled to Moscow on Kennedy’s behalf hoping to strike up a partnership with Andropov, including arranging some TV spots for the Soviets to propagandize Americans. Fortunately for America, Andropov died before this partnership came to fruition, and, once again, Kennedy was proved ever so wrong.

According to recently released KGB documents, Tunney also traveled to Moscow in March 1980, meeting with KGB agents. Agent Vasiliy Mitrokhin defected to Britain in 1992 and smuggled out copious notes of these meetings. Kennedy, battling Jimmy Carter for the Democrat nomination, thought that Carter was too belligerent with the Soviets and had caused souring relations. Mitrokhin noted that due to Kennedy’s disagreement with the Carter White House, the senator took foreign policy in his own hands in order to force Carter to act accordingly. Kennedy couldn’t help himself—actually fighting to win a war remains a foreign concept to white flag liberals.

Far worse, Kennedy and Tunney are likely guilty of treason—violating Article three, Section three of the U.S. Constitution, the U.S. Code and the Logan Act of 1799, barring citizens from giving aid and comfort to the enemy or from engaging in diplomacy with foreign governments in an effort to undermine U.S. policy. The junior senator from Massachusetts, one John F. Kerry, also remains guilty for meeting with the North Vietnamese in 1970.

Update: “Petition for Investigation and Indictment” of John F. Kerry for treason

In recent months, we have received thousands of inquiries about The Patriot’s “Petition for Investigation and Indictment” of John Kerry in reference to his anti-American activities during the Vietnam War. According to legal experts, Kerry’s meetings with enemy agents from Communist North Vietnam on multiple occasions between 1970 and 1972 are not covered under Jimmy Carter’s amnesty as outlined in EO 4483.

For that reason, on 22 October 2004, we delivered to then U.S. Attorney General John Ashcroft a “Petition for Investigation and Indictment” calling on the Department of Justice to determine conclusively whether Kerry’s actions, in direct violation of UCMJ (Article 104 part 904), U.S. Code (18 USC Sec. 2381 and 18 USC Sec. 953) and other applicable laws and acts of Congress, constitute treason, and disqualify him from any future campaign for any national office. We plan to pursue this issue, as its endorsers have requested, to its resolution. We fully expect an answer from Attorney General Alberto Gonzales, but the Justice Department has so far refused to take any action on the petition. In reality, given the political sensitivity of this request, we don’t expect any action until after the 2006 midterm elections at the earliest. To expedite our request, we are forming alliances with other groups like the Swift boat Vets, Vietnam Vets associations and POW groups, as well as moving forward with this legal challenge.

Nevertheless, the bottom line is we have no way of forcing the Justice Department’s hand on this. Any movement to investigate Kerry would be perceived as “purely political,” and thus the DoJ likely will not pursue it.

Nonetheless—we are loaded for bear and will make sure this issue is front and center should Kerry campaign for president again.

In the meantime, it’s not too late to sign the petition. We will update the number of signers each time we make official inquiry to determine the status of our request.
