Here are eight facts about New York’s new abortion law:

– The “fundamental” right to abortion is enshrined in the New York Constitution. “Every individual who becomes pregnant has the fundamental right to choose to carry the pregnancy to term, to give birth to a child, or to have an abortion, pursuant to this article,” the law states.

– The law allows non-physicians to perform abortions. “A health care practitioner licensed, certified, or authorized under title eight of the education law, acting in his or her lawful scope of practice, may perform an abortion,” the law states.

– The law allows abortion through the third trimester, including up to birth. “Third-trimester abortion will be allowed under the new law when a preborn child is diagnosed with a condition that will cause him or her to die at or shortly after birth,” Live Action reported.

– The law removes protections for babies who survive an abortion procedure. “The new law removes protections for babies born alive after an abortion — meaning they could be left to die after birth — by rescinding a portion of New York’s public health law,” Live Action reported. Late-term abortions, until now, were illegal in the state of New York.

– The law prevents pregnant women whose babies are killed in an attack on the mother from seeking justice and could result in infanticide by repealing the requirement for a second physician to be on hand in case an attempted abortion past 20 weeks yields a live infant.

– The law states that an unborn child cannot be a victim of homicide if he dies while in the womb following an attack on the mother. “‘Person,’ when referring to the victim of a homicide, means a human being who has been born and is alive,” the law states.

– Pro-abortion advocates said the law would protect legal abortion even in the event that the U.S. Supreme Court overturns the 1973 Roe v. Wade decision to make abortion legal — a decision that did no go as far as the New York law. “[The law] not only increases access to abortion across the board, including late-term abortions but also goes beyond Roe, which left some limits in place,” Catholic News Service reported.

– The law is to “prevent the enforcement of laws or regulations that are not in furtherance of a legitimate state interest in protecting a woman’s health that burden abortion access.”

New York’s Democrat Gov. Andrew Cuomo signed the bill into law.

The film was shot in secret and some teaser video will be shown at a pro-life rally in Washington this weekend.

A new pro-life film, Roe v. Wade, was shot in secret because filmmakers worried about backlash from pro-choice activists. The project, currently in postproduction, is now unveiling a three-minute teaser that is set to debut at the March for Life 2019 event this weekend in Washington, D.C.

The teaser opens with a scene featuring Oscar-winning actor Jon Voight, who plays U.S. Supreme Court Justice Warren Burger in the film, then cuts to modern-day news reports about Justice Brett Kavanaugh, including speculation that his appointment by President Donald Trump to the Supreme Court will "flip" the Roe v. Wade decision from the 1970s that basically legalized abortion.

Nick Loeb, who produced, co-wrote and co-directed Roe v. Wade, says the comparisons between what is being said now about Kavanaugh and was said when Roe v. Wade was re-argued in the early 1970s after a few President Richard Nixon appointees were on the court are strikingly familiar.

"Everyone is saying Kavanaugh is going to flip the decision and the same thing was said in 1972. There's actually a lot of parallels between then and now," Loeb told The Hollywood Reporter.

Legal Issues of Roe v. Wade

First of all, Roe v. Wade did not legalize abortion. 


Contrary to popular perception, the majority opinion in Roe did not affirm a constitutional right to privacy, much less a right to have an abortion.


Roe and all subsequent abortion cases have established a culture where the Supreme Court, rather than the legislature, dictates the content of abortion legislation, often in painstaking detail. Though Roe itself had little regard for the text of the Constitution and effectively ignored a century of prior jurisprudence, Roe’s defenders have solemnly appealed to the principle of stare decisis to preserve Roe as an established precedent. Revolutionaries despise traditional authority until they gain power, at which point authority again becomes sacred. Since the legal arguments of Roe are virtually nonexistent, it can only be defended by the argument from authority, stare decisis, a principle which Roe itself thoroughly repudiated.

"The most controversial of the civil rights cases is undoubtedly Roe v. Wade, 410 U.S. 113 (1973), which has been applied in a way that effectively establishes an unwritten constitutional right to have an abortion, though the opinion of Roe itself made no such assertion directly. Roe represents a twofold failure of judicial social engineering, since it (1) applied a uniform legal solution over all the states on a highly contentious issue that opens deep moral, religious, and philosophical fissures, and (2) was poorly reasoned and not grounded in law, giving it little intellectual legitimacy. We are only going to consider the second aspect of Roe, its failing as a legal argument.Roe’s intellectual inadequacies are well known and criticized among legal scholars, even those who personally favor a right to abortion.[1] These criticisms have not reached a larger audience, however, due to the superficial coverage of legal matters by the mass media. Accordingly, we need to clear some common misconceptions before examining the opinion of Roe itself, which is often cited but seldom read."

As subsequent history has proven, the Court did not settle the abortion issue, but nationalized it, creating militant opposition groups with national reach. The Court, by legislating from the bench one time too many, itself became an object of competing political ideologies. Instead of debating abortion in state legislatures, the battle is waged through judicial appointments, and as Roe cannot stand on the basis of its weak arguments alone, the abortion issue will be held hostage by the courts until the pre-Warren understanding of the role of the judiciary holds sway once again.

Some in the animal-protection movement mistake the cause for a part of the liberal progressive agenda (as if the Obama years have ushered in some golden era of cruelty-free living in America) and can be so wrapped up in that ideology as to ignore the most obvious of connections. In what moral universe does it makes sense to protect a wolf, pig, dog, or any other animal from needless suffering and violence, but not a human baby stirring in her mother’s womb? To their lasting credit, many animal activists post pictures on the Internet from factory farms, slaughterhouses, laboratories, and elsewhere, scenes so nightmarish at times that you have to study them for a moment before the horror of what’s unfolding becomes clear. How many of those same good people have ever brought themselves to look at pictures and films (even the ultrasonic and relatively endurable Silent Scream) showing what happens in an abortion, especially after the second or third month of fetal development, and to whom it happens? Different people are called to serve different causes, and if your vocation is to protect animals then no one is saying you have to sign up right away at National Right to Life. But if the creed is empathy for the weak, shouldn’t your sympathies at least lie in that direction?

Representative Steve King of Iowa, for example, is a solid pro-life vote every time and, just as dependably, an apologist for animal cruelty. He typifies a certain way of looking at animals that manages to be both lofty in tone and morally obtuse in practice. An influential member of the House Agriculture Committee, the man has opposed any kind of leniency for farm animals, dogs in puppy mills or dog-fight rings, birds used by cockfighters, horses bound for slaughter plants, exotic wildlife slain by big-game trophy hunters, any creature at all. All the while, he uses his pro-life principles as a pretext for doing nothing on behalf of animals, in a version of the abortion–cruelty connection that other conservatives have also traded on. The idea is that since the law does not now grant full protection to the unborn, any attempt to protect animal life is an expression of profoundly misplaced priorities, subversive to the sanctity of human life, an affront to Man in all his glory. The result of this high-minded stance? Glorious man, made in the image of God, can go back to his dog-fighting, cock-fighting, chick-grinding, hog torture, wolf slaughter, and general abuse of the animal world without being held to account.

If it is possible to give pro-life principles a bad name, little tyrants like Steve King are the ones who can do it. They are making excuses, not arguments. They are friends of power, not of life, serving no cause except human arrogance — in the spirit of what Governor Bob Casey used to call the Imperial Self. By showing such contempt for the healthy majority of voters in both parties who care about animals, they aren’t doing the Republican party any favors, either.

"The factory farms — producing almost every animal product we see sold or advertised, in our country and most others — are places of immense and avoidable suffering. And though the moral stakes are not the same as with abortion, the moral habits are, relying in both cases on the averted gaze and a smothering of empathy."

Opinions on abortion are changing

Overall, the survey suggests that the 20-week abortion measure fractures some of the modern Democratic coalition. Among all age groups, it was young Americans--who have regularly sided with Democratic priorities in the age of Obama--who most strongly supported the measure (52 percent). The measure also received the support of 51 percent of white women, both those who are college educated and those who are not.

The absurdity of Jeb Bush

"Immigrants create far more businesses than native-born Americans," Bush said. "Immigrants are more fertile, and they love families, and they have more intact families, and they bring a younger population. Immigrants create an engine of economic prosperity."

I thought of it first, when Rush first started talking about this in his morning show today...but then, of course, Rush finally mentioned the "A" word--abortion. Here's the problem:

Abortion is pushed on the American public and you are demonized if you oppose it.

Now we are told that we need immigrants to breed.

Does this make sense???

I live in California and Jeb Bush has lost his mind if he thinks immigrants "create an engine of economic prosperity"--I have seen perfectly nice middle class neighborhoods that now look like Tijuana. Our state is dying--just ask anyone who owns California municipal bond funds, if nothing else!

Jeb Bush should take a damned drive around this state before he makes any more absurd statements.
